… but did not notify the legislature, or let his vice deputise for him. His lawyer, Mr Alex Izinyon interprets this excerpt of Section 145 of the Nigerian constitution:
Whenever the President transmits to the President of the Senate and the Speaker of the House of Representative a written declaration that he is proceeding on vacation or that he is otherwise unable to discharge the functions of his officer, until he transmit to them a written declaration to the contrary such functions shall be discharged by the Vice-President as Acting President

The above means in simple terms and can be paraphrased as follows: any time the President wants to go on vacation or he is unable otherwise to discharge the function of his office, if he wants such function of the office of President to be discharged while he is on vacation or unable to discharge his function, he should transmit to the President of the Senate and the Speaker that he is proceeding on vacation or unable to discharge the function of his office. Once he writes the President of the Senate and Speaker, automatically, the Vice-President shall function as Acting President. But if he does not transmit to the President and the Speaker any written declaration that he is proceeding on vacation or unable to discharge the function of his office, (but he is not in office officially), it means the Vice President cannot function as Acting President. It means the President wherever he is remains the President and he still can discharge his function as President.
